Statement on Challenge to Philly’s “ICE Out” Law
Fear of participating in our justice system makes all Philly communities less safe.
PHILADELPHIA—”The Defender Association of Philadelphia is disappointed by the federal government’s challenge to the ICE Out legislation passed by City Council, a law designed to ensure that all Philadelphians can safely access courts, schools, hospitals, and other essential public services without fear.
“Our office represents immigrants who have lived in our communities for years, who are raising families, working, attending school, and contributing to the life of this city. We see firsthand what happens when fear of immigration enforcement makes people afraid to appear in court, report crimes, seek medical care, or access other critical services. This fear makes our justice system less fair and efficient, and our communities less safe.
“The ICE Out laws are more than a reflection of Philadelphia’s longstanding commitment to public safety, accountability, and equal access to justice. They help ensure that city resources remain focused on serving Philadelphia residents rather than carrying out federal civil immigration enforcement. They promote transparency and accountability while helping preserve trust between public institutions and the communities they serve.
“The Defender Association believes that policies that promote access to the courts and essential services without fear make a stronger, safer and fairer Philadelphia. We will continue to stand with our clients, our community partners, and all Philadelphians in support of due process, public trust, and equal access to justice.”
